On December 20th, 2018, President Trump signed the 2018 Farm Bill that legalized the cultivation and sale of hemp at the federal level, effective in the New Year on exactly January 1st, 2019.

Breaking Down the 2018 Farm Bill

  • Hemp defined as the plant Cannabis sativa L and any part of the plant with a Delta-9 THC concentration no higher than 0.3 percent by dry weight
  • Hemp removed from Controlled Substances Act, making it legal to cultivate, possess, sell and distribute
  • States and Indian tribes have broad authority to regulate and limit the production and sale of hemp and its products within their borders
  • However, they cannot limit the transportation or shipment of hemp and its products through their jurisdictions

  • However, if production meets federal and state level regulations, it can be considered a legal compound

  • CBD products that are approved by the FDA, such as CBD-based medication, are an exception

State-Level Medicinal Cannabis Unaffected

  • The Farm Bill will not change state-level medicinal cannabis programs
  • Medicinal cannabis will still be illegal at the federal level
